New York Cannabis: Crisis in fines! In a revealing update on New York’s cannabis market, it has come to light that a significant portion of fines imposed on unauthorized cannabis retailers remains unpaid, highlighting the enforcement difficulties plaguing the state.
Authorities have issued over $25 million in fines against these unlicensed entities, yet, astonishingly, only $22,500 has been successfully collected. This revelation points to the substantial enforcement hurdles facing the state’s cannabis market.
This situation follows reports from last October indicating that efforts to clamp down on illegal cannabis sales have largely been ineffective, with many cases unresolved. Regulatory measures had been put on pause, including administrative hearings that could impose fines and other sanctions on those found selling cannabis without authorization.
The state’s regulatory framework allows for fines of $10,000 for each day of unauthorized sales, with the penalty escalating to $20,000 per day if the retailer continues operations after receiving a cease order from the Office of Cannabis Management (OCM).
In response to these challenges, and amidst calls for increased enforcement from figures such as New York’s Governor, there’s ongoing discussion among lawmakers about amending the 2021 legalization legislation, known as the Marihuana Regulation and Taxation Act, to better facilitate retail sales of cannabis. Despite the rocky start to its adult-use cannabis market, which officially began on December 29, 2022, sweeping changes to the legislation have been deemed unlikely by the Governor, who has labeled the rollout a “disaster.”

Once again cannabis regulation rears its ugly head. Couple weeks past in cannabis news, we spoke about how NYC has only allowed for 50 brick and mortar dispensaries. This is creating a massive bottleneck between the growers and the consumers. Illegal dispensaries are popping up, making a ton of money selling all the weed that legal growers have no where to sell. Once they get caught they just close up and retire without paying the fees.
$23,000 paid out of 20 million is a big middle finger to the city. NYC just green lit a bunch of brick and mortar dispensaries after catching all the heat for destroying a quarter MILLION pounds of cannabis because they had no where to sell it. I hope they untangle the mess their cannabis regulation choices have left them.
